The Gauteng Division of the High Court in Pretoria has declared certain provisions in the Criminal Law , Sexual Offences and Related Matters, Act to be unconstitutional and invalid, as they do not criminalise sexual violence where the perpetrator wrongly and unreasonably believes that the complainant was consenting to the sexual act.
